			<content:encoded><![CDATA[<p>In a new blog post at &#8220;<a href="http://isenbergondomains.com/" target="_blank">Isenberg On Domains</a>,&#8221; Doug Isenberg writes about, &#8220;<a href="http://isenbergondomains.com/2013/04/04/what-you-really-need-to-know-about-icanns-trademark-clearinghouse/" target="_blank">What You Really Need to Know About ICANN&#8217;s Trademark Clearinghouse</a>.&#8221; In the post, Isenberg writes that:</p>
<ul>
<li>Registering a trademark with the TMCH does not entitle you to any domain names.</li>
<li>TMCH participants are not guaranteed domain name registrations even during the sunrise periods.</li>
<li>The TMCH’s “Trademark Claims Service” won’t prevent cybersquatting.</li>
<li>The TMCH’s attenuated protections are limited to “exact matches” and other narrow criteria.</li>

<blockquote><p>The numbers tell the story: The World Intellectual Property Organization (WIPO) received 2,884 domain name disputes in 2012, its most ever. The number of cases has risen ever year since 2003, with one exception in 2009 (the year following the global recession).</p>
<p>In addition, the total number of domain names  in dispute (because one case can include multiple domain names) also hit  a record level last year, reaching 5,081 domain names.</p></blockquote>

			<content:encoded><![CDATA[<p><em>Franchise Times</em> magazine interviewed attorney Doug Isenberg of The GigaLaw Firm about cybersquatting in an <a href="http://www.franchisetimes.com/November-December-2012/Brazen-Conduct/" target="_blank">article</a> published in the November/December 2012 issue, under the headline, &#8220;&#8216;Serial offender&#8217; keeps going, at expense of 90 major brands.&#8221;</p>
<p>The article focused on a cybesquatter, Jason Rager a/k/a Paydues, who has registered numerous domain names containing trademarks owned by well-known franchisors. In May 2012, Isenberg won a case for Holiday Inn against Paydues under the Uniform Domain Name Dispute Resolution Policy (UDRP).</p>
<p>In the article, Isenberg advises trademark owners that face cybersquatting problems: &#8220;Do something. It may be impossible to pursue every cybersquatter, but the right thing to do is at least pursue those that are causing the most problems, and to make yourself known as a trademark owner who enforces the brand online.&#8221;</p>
